Gen Musharraf ECL case: Supreme Court sets aside SHC ruling

ISLAMABAD: The Supreme Court of Pakistan on Monday declared null and void a decision of the Sindh High Court allowing former president Gen. (retd) Pervez Musharraf to leave the country, Samaa reports.
The apex court’s ruling came in response to an appeal filed by the federal government.
The Sindh High Court earlier this month ordered removal of Musharraf’s name from the exit control list.
A two-member bench comprising Justice Shahnwaz Tariq and Justice Muhammad Ali Mazhar in its ruling had said the federal government can file an appeal against the ruling within 15 days; therefore, the decision will be effective after 15 days.
Musharraf had filed an appeal in the SHC seeking removal of travel ban to visit his ailing mother in Dubai and get treatment abroad; however, the federal government has refused to allow him, on the grounds that he is facing treason charges.
The 70-year-old Musharraf was indicted in March on charges relating to his imposition of emergency rule in late 2007. The ex-general, who seized power in 1999 and resigned in 2008, has pleaded "not guilty" to the charges. – SAMAA

Government files appeal against SHC order on ECL case

The federal government on Saturday has filed an appeal against Sindh High Court’s order of removing the name of former president Pervez Musharraf from the exit control list, Samaa reports.
The appeal was filed at the Supreme Court of Pakistan by deputy attorney general on behalf of the federal government.The federal government has prayed before the court that Musharraf should not be allowed to travel abroad until disposal of cases against the former military ruler.
It has also prayed that SHC’s order in this regard should be declared null and void.It is pertinent to mention that SHC on Thursday ordered removal of Musharraf’s name from government’s no fly list.A two-member bench comprising Justice Shahnwaz Tariq and Justice Muhammad Ali Mazhar in its brief ruling had said the federal government can file an appeal against the ruling within 15 days; therefore, the decision will be effective after 15 days.Musharraf had filed an appeal in the SHC seeking removal of travel ban to visit his ailing mother in Dubai and get treatment abroad; however, the federal government has refused to allow him, on the grounds that he is facing treason charges.

متحدہ قومی موومنٹ کے قائد جناب الطاف حسین نے سندھ ہائی کورٹ کی جانب سے سابق صدر (ر)جنرل پرویز مشرف کا نام ایگزٹ کنٹرول لسٹ سے نکالنے اور بیرون ملک جانے کی درخواست منظور کئے جانے کا خیر مقدم کیا ہے ۔ ایک بیان میں انہوں نے کہاکہ پرویز مشرف کی والدہ محترمہ بیرون ملک میں شدید علیل ہیں اور ان کی عیادت کیلئے پرویز مشرف کی جانب سے نام ای سی ایل سے نکالنے کی درخواست کی گئی تھی جسے آج سندھ ہائی کورٹ نے منظور کرلیا ہے ۔انہوں نے کہاکہ سندھ ہائی کورٹ کا فیصلہ خوش آئند ہے جس پر میں پرویز مشرف سمیت اے پی ایم ایل کے تمام ذمہ داران وکارکنان کو دلی مبارکباد پیش کرتا ہوں ۔ جناب الطاف حسین نے پرویز مشرف کی والدہ محترمہ کی علالت پر گہری تشویش کااظہار کیا اور ان کی جلد ومکمل صحت یابی کیلئے دعا بھی کی

KARACHI: Sindh High Court has ordered removal of former president Pervez Musharraf’s name from government’s Exit Control List (ECL), SAMAA reported.A two-member bench comprising Justice Shahnwaz Tariq and Justice Muhammad Ali Mazhar announced a brief ruling, allowing the former army chief to fly abroad.In its ruling, the bench said federal government can file an appeal against the ruling within 15 days; therefore, the decision will be effective after 15 days.Musharraf had filed an appeal in the SHC seeking removal of travel ban to visit his ailing mother in Dubai and get treatment abroad; however, the federal government has refused to allow him, on the grounds that he is facing treason charges.The 70-year-old Musharraf was indicted in March on charges relating to his imposition of emergency rule in late 2007. The ex-general, who seized power in 1999 and resigned in 2008, has pleaded "not guilty" to the charges.
He faces the death penalty if convicted of the charges, under Article 6 of the Constitution.
Musharraf is also on bail in three other major cases linked to his time in power including 2007 assassination of PPP leader Benazir Bhutto in a gun and suicide attack and murder of Baloch leader Nawab Akbar Bugti in 2006. – SAMAA

کراچی....سندھ ہائیکورٹ نے پرویز مشرف کا نام ای سی ایل سے نکالنے کی درخواست منظورکرتے ہوئے حکم دیا ہے کہ سابق صدر مشرف کا نام ای سی ایل سے نکالا جائے۔عدالتی حکم میں کہا گیا ہے کہ فیصلے پر 15 دن تک عمل درآمد نہیں ہوگا،اس عرصے میں مخالف فریق اپیل دائر کرسکتے ہیں۔سندھ ہائی کورٹ کے جسٹس محمد علی مظہر اور جسٹس شاہ نواز طارق پر مشتمل بینچ نے سابق صدر جنرل ریٹائرڈ پرویز مشرف کا نام ای سی ایل سے نکالنے سے متعلق درخواست فریقین کے وکلا کے دلائل سننے کے بعد 29 مئی کو فیصلہ محفوظ کرلیا تھا۔ گذشتہ سماعت پر پرویز مشرف کے وکیل بیرسٹر فروغ نسیم نے موقف اختیار کیا کہ وفاقی حکومت نے حقائق چھپائے جو بدنیتی پر مبنی ہےآئین کے مطابق کسی کو انفرادی طور پر آئین پامال کرنےکا ذمہ دار قرار نہیں دیا جاسکتا، پرویز مشرف نے تین نومبر کی ایمرجنسی وزیر اعظم اور وفاقی کابینہ کی مشاورت سے لگائی۔ تمام شواہد و حقائق کا ریکارڈ موجود ہے لیکن اسے غائب یا ختم کیا جا رہا ہے۔ جواب میں موقف اختیار کیا گیا کہ سابق صدر کی والدہ علیل ہیں اور ریڑھ کی ہڈی میں فریکچر ہےعلاج اور تیمارداری کےلئے وہ باہر جانا چاہتے ہیں ۔بیرسٹر فروغ نسیم نے دلائل دیے کہ سپریم کورٹ کا 31مارچ 2014کاتفصیلی فیصلہ آنے کے بعد 8 اپریل 2013 کا عبوری حکم ختم ہوگیا ،اس لیے مشرف کا نام ای سی ایل سے نکالا جائے ۔ اٹارنی جنرل سلمان اسلم بٹ نے موقف اختیار کیا کہ سنگین غداری کے مقدمے کی تفتیش کے لئے پرویز مشرف کی ملک میں موجودگی ضروری ہے۔ سنگین غداری کے مقدمے کی سزا موت یا عمر قید ہے اور یہ سیاسی جرائم کے زمرے میں آتاہے۔انہوں نے کہاکہ سپریم کورٹ نے 8 اپریل 2013 کو اپنے حکم میں دو ہدایات دیں۔ ایک یہ کہ پرویز مشرف کا نام ای سی ایل میں ڈالا جائے اور اس حکم کو عدالت کی کسی ترمیم یا نظر ثانی تک برقرار رکھا جائے ۔دوسری ہدایت یہ تھی کہ وفاق کے تمام ادارے پرویز مشرف کو ملک سے باہر نہ جانے دیں۔ اٹارنی جنرل نےسندھ ہائی کورٹ کے اختیار سماعت پر بھی اعتراض برقرار رکھا۔ عدالت نے دلائل سننے کے بعد فیصلہ محفوظ کرلیا تھا جو آج سنادیا گیا۔

Gen Musharraf gets clean chit in Lal Masjid operation

ISLAMABAD : The Islamabad police have completed the challan in the murder of Allama Abdul Rashid Ghazi, Naib Khateeb (deputy cleric) Lal Mosque, and his mother, and submitted it in the court of Additional Sessions Judge Wajid Ali, says a press release issued by Shauda Foundation. According to the statement, the challan of Ghazi’s murder was prepared by SHO Police Station Koral Iftikhar Chatta, which was confirmed by a joint investigation team (JIT) under DIG Islamabad Khalid Khattak.
The JIT ignored all the evidence against former President Gen (Retd) Pervez Musharraf and declared him innocent in the case. They have kept Musharraf in column II of the challan. It was written in the challan that there was no direct evidence of Musharraf’s involvement in Lal Masjid operation. The report left the former dictator at the mercy of the court.

اسلام آباد(مانیٹرنگ ڈیسک) پرویز مشرف کی ایمرجنسی کے سلسلے میں اُس وقت کی شوکت عزیزکابینہ کے چھ نومبر کے اجلاس کے منٹس سے متعلق نئے حقائق منظر عام پرآگئے ہیں جس کے مطابق اُس وقت کے آرمی چیف پرویز مشرف کی طرف سے تین نومبر 2007ءکی ایمرجنسی کے اقدام کی شوکت عزیز کابینہ نے تین دن بعد توثیق کردی تھی ۔غداری کیس کی سماعت کرنیوالی خصوصی عدالت میں جمع کرائی گئی دستاویز ات کے مطابق چھ نومبر 2007ءکے کابینہ اجلاس میں اس وقت کے وزیراعظم شوکت عزیز نے ارکان کوایمرجنسی کے نفاذ پر اعتمادمیں لیا اورکسی رکن نے اعتراض نہیں کیا ، اگر کیا تو اس کا رپورٹ میں کہیں ذکرموجود نہیں ۔نجی ٹی وی چینل نے دستاویزات کاحوالہ دیتے ہوئے کہاکہ شوکت عزیز اجلاس کے آخری سیشن میں ”عوامی اہمیت کے معاملات“ کے عنوان سے معاملہ سامنے لائے تھے ۔ وزراءکو بتایاگیاکہ ملک میں امن وامان اور سلامتی کی مخدوش صورتحال ، عدلیہ کے حکومتی کارکردگی پر اثراندازہونے کے باعث ایمرجنسی کا نفاذ ناگزیر ہوگیاتھا۔ اُس وقت کے وزیراعظم نے کابینہ کو یقین دہانی کرائی تھی کہ ایمرجنسی کے نفاذ سے انتخابات میں کوئی تاخیر ہوگی اور نہ ہی جمہوری عمل سست پڑے گا۔
